1.Article XXII If international treaties which the PRC has signed, or has acceded to, have different provisions that differ from these regulations, the provisions in the international treaties shall apply, except for those provisions for which the PRC had stated reservation.
第二十二条中华人民共和国缔结或者参加的国际条约同本条例有不同规定的，适用国际条约的规定；但是，中华人民共和国声明保留的条款除外。
2.(3) whether or not any application for a patent for design obviously falls under Article 5 of the Patent Law, or is not in conformity with the provisions of Article l8 or of Article l9, paragraph one of the Patent Law, or is obviously not in conformity with the provisions of Article 3l, paragraph two, or of Article 33 of the Patent Law, or of Rule 2, paragraph three, or of Rule l3, paragraph one, or of Rule 43, paragraph one of these Implementing Regulations, or is not entitled to a patent right in accordance with the provisions of Article 9 of the Patent Law.
(三)外观设计专利申请是否明显属于专利法第五条的规定，或者不符合专利法第十八条、第十九条第一款的规定，或者明显不符合专利法第三十一条第二款、第三十三条、本细则第二条第三款、第十三条第一款、第四十三条第一款的规定，或者依照专利法第九条规定不能取得专利权。
3.(2) whether or not any application for a patent for utility model obviously falls under Article 5 or 25 of the Patent Law, or is not in conformity with the provisions of Article l8 or of Article l9, paragraph one of the Patent Law, or is obviously not in conformity with the provisions of Article 26, paragraph three or four, or of Article 3l, paragraph one, or of Article 33 of the Patent Law, or of Rule 2, paragraph two, or of Rule l3, paragraph one, or of Rule l8 to 23, or of Rule 43, paragraph one of these Implementing Regulations, or is not entitled to a patent right in accordance with the provisions of Article 9 of the Patent Law;
(二)实用新型专利申请是否明显属于专利法第五条、第二十五条的规定，或者不符合专利法第十八条、第十九条第一款的规定，或者明显不符合专利法第二十六条第三款、第四款、第三十一条第一款、第三十三条、本细则第二条第二款、第十三条第一款、第十八条至第二十三条、第四十三条第一款的规定，或者依照专利法第九条规定不能取得专利权；
4.The provisions of this Agreement shall be deemed severable, and the invalidity or unenforceability of any one or more of the provisions of this agreement shall not affect the validity and enforceability of the other provisions.
本协议的规定应被认为是可以中止的，协议中的任何一个或几个规定的无效或不可实施应不影响其他规定的有效性和实施。
5.A waiver by one of the parties of any of the provisions of the Agreement (or of any default by the other party in performing any of those provisions) shall not constitute a continuing waiver and shall not prevent the waiving party from subsequently enforcing any of the other provisions of this Agreement or from acting on any subsequent default.
任何一方的某一次弃权或对对方执行情况的默认并不构成永久的弃权，也不影响弃权方行使协议中的其他规定或随后对默认的情况采取行动。
6.The grounds on which the request for invalidation is based, referred to in the preceding paragraph, mean that the invention-creation for which the patent right is granted does not comply with the provisions of Article 22, Article 23, or of Article 26, paragraph three or four, or of Article 33 of the Patent Law, or of Rule 2, or of Rule l3, paragraph one, or of Rule 20, paragraph one, or of Rule 21, paragraph two of these Implementing Regulations; or the invention-creation falls under the provisions of Articles 5 or 25 of the Patent Law; or the applicant is not entitled to be granted the patent right in accordance with the provisions of Article 9 of the Patent Law.
前款所称无效宣告请求的理由，是指被授予专利的发明创造不符合专利法第二十二条、第二十三条、第二十六条第三款、第四款、第三十三条或者本细则第二条、第十三条第一款、 第二十条第一款、第二十一条第二款的规定，或者属于专利法第五条、第二十五条的规定，或者依照专利法第九条规定不能取得专利权。
7.(2) where the application falls under the provisions of Article 5 or 25 of the Patent Law, or it does not comply with the provisions of Article 22 of the Patent Law or of Rule l3, paragraph one, or of Rule 20, paragraph one, or of Rule 21, paragraph two of these Implementing Regulations, or the applicant is not entitled to a patent right in accordance with the provisions of Article 9 of the Patent Law;
(二)申请属于专利法第五条、第二十五条的规定，或者不符合专利法第二十二条、本细则第十三条第一款、第二十条第一款、第二十一条第二款的规定，或者依照专利法第九条规定不能取得专利权的；
8.Article 1 For the purpose of strengthening the administration of accredited supervisors and regulating their behaviors of on-the-spot supervision and inspection over drug production, these Provisions are formulated in accordance with the relevant provisions of the Pharmaceutical Management Law and other related provisions on drug manufacturing supervision and management.
第一条为进一步加强对派驻监督员的管理，规范其药品生产现场监督检查行为，根据《药品管理法》以及药品生产监督管理的有关规定，制定本规定。
9.As a unified and standard document of international and national law on the protection of expression of folklore which was drafted by UNESCO and WIPO on the initiative of developing countries, Model Provisions For National Laws on the Protection of Expressions of Folklore Against Illicit Exploitation and Other Prejudicial Actions (short for Model Provisions thereafter) has provided a model deserving being used for reference for the legal protection of expressions of folklore of every country .
《关于保护民间文学表达形式以防止非法利用和其他有害行为的国家法律示范法条》(以下简称《示范法条》)作为由发展中国家倡导的,由联合国教科文组织(UNESCO)和世界知识产权组织(WIPO)共同起草的保护民间文学艺术的国际与国内法上的统一标准文件,为各国的民间文学艺术保护提供了可资借鉴的范本。
10.The methods of ascertaining product quality through inspection and quarantine shall be carried out in accordance with the relevant provisions approved by the State Council; in the absence of such provisions, the parties shall determine the methods through consultation.
产品质量的验收、检疫方法，根据国务院批准的有关规定执行，没有规定的由当事人双方协商确定。
